The Supreme Court on Tuesday rejected a Special Leave Petition (SLP) filed by Deepak Fertilizers challenging a property tax notice issued by the Panvel Municipal Corporation (PMC) for its Taloja MIDC unit, a statement released by PMC on Wednesday, said. “The ruling marks a significant win for the civic body and paves the way for further tax recovery from industrial units in the region,” PMC spokesperson said.
The apex court bench comprising Justices B.V. Nagarathna and Satish Chandra Sharma declined to grant any relief or stay to Deepak Fertilizers and directed the company to approach the High Court if it seeks any leniency in the matter. With this, the SLP was dismissed, upholding the Bombay High Court's earlier decision.
“The case has broader implications as it could affect other companies operating in the Taloja MIDC area. Following the Supreme Court's decision, we can now move ahead more smoothly in collecting property taxes,” the statement emphasised.
PMC Commissioner Mangesh Chitale had directed Additional Commissioner Ganesh Shete and Deputy Commissioner Swaroop Kharge to remain present during the Supreme Court proceedings. The civic body presented all relevant records, including documentation from the era of Gram Panchayat governance to the current municipal administration.
Deepak Fertilizers was represented by senior advocate Kapil Sibal, while PMC's legal team included Solicitor General Tushar Mehta and senior advocates Patwalia, Sudhanshu Chaudhary, and Samrat Shinde.
